Notice on the Prohibition of International Students' Illegal Work in China

Recently, the Exit-Entry Bureau of Beijing Municipality and various public security departments have stepped up efforts to investigate the illegal employment of international students, and conducted investigations on foreign students holding study visas or residence permits. According to Article 43 of theExit and Entry Administration Law of the People’s Republic of China, any of the following acts of foreigners shall be deemed unlawful employment:

(1) Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;

(2) Work in China beyond the scope prescribed in the work permits; or

(3) Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.

According to Article 80 of theExit and Entry Administration Law of the People’s Republic of China,any foreigner that is found working illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan.

All international students are advised not to participate in any illegal

work or transaction outside the campus.

Meanwhile, according to Article 13 of theRegulations on Disciplinary Action Against Students of Beijing Foreign Studies University students may be expelled from the University if he or she is subject to security administration punishment or criminal detention due to severe and wicked violation of law.

Neither the Exit-Entry Administration nor the University will cover or condone international students who work illegally. All international students are prohibited from participating in any illegal employment or other commercial and non-commercial employment activities.
