Work-study Management Measures for International Students of Beijing Foreign Studies University (Provisional)

I. General Provisions

Article 1 These Measures are formulated based on theWork-study Management Measures for International Students in Chinese Universities(No.2, the General Office of the Ministry of Education [2021]) jointly developed by the Ministry of Education, Ministry of Public Security, Ministry of Human Resources and Social Security, and the National Immigration Administration, in order to regulate work-study management of international students at Beijing Foreign Studies University (“BFSU”), safeguard the legitimate rights and interests of international students, and promote the safe and orderly conduct of work-study activities for international students.

Article 2 The term “international students” as used herein refers to non-Chinese nationals who study at BFSU, according tothe Nationality Law of the People’s Republic of China.

Article 3 The term “work-study” refers to part-time work conducted by international students under the organization and management of BFSU during their spare time within the permitted scope of these Measures to earn lawful renumeration to improve their study and living conditions. These activities do not include teaching internships and social practices organized by BFSU according to teaching plans.

Article 4 International students participating in work-study activities shall abide by relevant Chinese laws and regulations. They shall enjoy rights stipulated by Chinese laws and regulations and fulfill obligations specified hereby.

II. Basic Principles

Article 5 BFSU implements a permit mechanism for international students who wish to participate in work-study activities, along with measures for orderly entry and exit as well as dynamic supervision. International students and relevant BFSU departments are subject to the management of BFSU in the whole process.

Article 6 The work-study activities of international students are subject to the comprehensive leadership of the Foreign Affairs Working Group of BFSU, with specific activities managed by the Overseas Students Affairs Office.

Article 7 The Overseas Students Affairs Officeis responsible for approving on-campus part-time working positions, processing applications for work-study activities by international students, formulating renumeration and reward standards for on-campus work-study activities, processing applications for registration on their residence permits for international students who participate in off-campus work-study activities, and conducting aware-raising activities on relevant laws and regulations, etc. BFSU schools or colleges are responsible for approving applications regarding off-campus work-study activities by international students who study at their own schools or colleges. On-campus employers are responsible for assigning job positions for international students at their own departments, providing remuneration, and evaluating performance. The Financial Affairs Office is responsible for the disbursement and management of renumeration for on-campus work-study activities.

III. Application Requirements

Article 8 International students who wish to participate in work-study activities must meet the following basic requirements:

(1) Be at least 18 years old, abide by Chinese laws and regulations as well as BFSU rules and regulations, maintain good conduct and performance, and have no records of violations against any laws and rules, or misconducts during their stay;

(2) Possess a valid residence permit for studying in China with remaining validity of six months or more.

(3) Undergraduate students, graduate students, and visiting students who have studied non-stop at BFSU for at least one year.

(4) Have registered as required, continued normal academic progress with attendance and academic performance in good standing or above.

(5) Have insurance that covers work-study activities.

Article 9 In principle, off-campus work-study activities of international students shall be related to their academic studies. BFSU will not arrange or authorize its international students to participate in toxic, harmful, or dangerous work.

Article 10 The work-study activities of international students shall not occupy normal study time, and their workplace shall be limited within the administrative area of Beijing.

IV. Job Positions and Renumeration Standards

Article 11 In principle, international students shall engage in work-studyactivities forno more than 8 hours per week and 40 hours per month, or 16 hours per week and 80 hours per month during winter and summer breaks.

Article 12 On-campus work-study positions mainly include teaching assistants, research assistants, administrative assistants, and other public service jobs. These positions shall meet the students’ needs without disrupting their academic schedules.

Article 13 Fixed on-campus positions are paid on a monthly basis, and total renumeration for 40 hours per month shall not in principle be lower than the minimum living cost for Beijing residents and be subject to upward or downward changes appropriately. Temporary on-campus positions are paid on an hourly basis, with the hourly pay reasonably determined with reference to the minimum hourly pay standards of Beijing. For off-campus work-study activities, the renumeration shall not be lower than the minimum pay standards stipulated by the Beijing Municipal People’s Government or relevant authorities, with the exact sum to be negotiated between the employers and the students themselves and specified in the employment agreements.

V. Application and Approval

Article 14 International students participating in on-campus and off-campus work-study activities shall apply personally and gain approval from their schools or colleges and theOverseas Students Affairs Office. The duration of their work shall not exceed the validity period of their student residence permits, with a maximum duration of one year.

Article 15 On-campus departments and units that accept international students for work-study activities must first report to theOverseas Students Affairs Office.

Article 16 International students participating in off-campus work-study activities are required to sign employment agreements (hereinafter referred to as the “Agreement”) with their employers. The Agreement shall be written in Chinese, and includes but not limited to basic information such as the employer’s name, address, and contact person. The Agreement shall also specify the rights and obligations of both parties, duration of the agreement, insurance responsibilities, as well as details of the job position such as the specific tasks, location, duration, renumeration, and procedures for handling injuries and accidents, labor disputes, etc.

Article 17 Procedures for applying for registration on their residence permits for international students participating in off-campus work-study activities:

(1) An international student must provide his/her school or college with an original copy of the Agreement signed with the employer for verification, along with other documents such as a copy of the Agreement and a copy of the employer’s business license, an off-campus work-study application form, a letter of commitment for off-campus work-study, and a copy of insurance document that covers the work-study activities, etc. Students are responsible for ensuring that the documents are authentic, accurate, complete and valid.

(2) The relevant school or college shall verify the application documents submitted by the students, contact the employers for confirmation, and sign and stamp on the off-campus work-study application after verification.

(3) International students shall submit the above-mentioned documents provided by the employers and BFSU schools or colleges to theOverseas Students Affairs Officefor re-examination. Eligible students will obtain a letter of consent from theOverseas Students Affairs Officeand go to the exit-entry administration authorities to apply for registration on their residence permits.

Article 18If an international student wish to change his/her off-campus employer or duration of work, he/she shall repeat the same procedures as described above.

Article 19International students who wish to terminate their off-campus work-study activities early shall submit a written explanation to the Overseas Students Affairs Office ten days in advance, and the Office shall guide the students to go to the exit-entry administration authorities to alter relevant information.

Article 20International students cannot engage in off-campus work-study activities if their residence permits are not registered with relevant information.

VI. Daily Management

Article 21 International students shall not engage in work-study activities that are not consistent with their status or violate Chinese laws and regulations.

Article 22 The Overseas Students Affairs Officeshall work together with relevant departments to effectively fulfill its responsibility of managing international students’ work-study activities, strengthening daily education, inspection and tracking, regulating work-study activities, and safeguarding students’ legal rights and interests.

Article 23 On-campus employers shall provide guidance and supervision to international students participating in work-study activities within their own institutions. They should keep records of the students’ work performance which includes but not limited to attendance, work attitude, working hours, completion of tasks, etc. and report such information to theOverseas Students Affairs Officein a timely manner.

Article 24 International students who fall into the following categories shall have their work eligibility revoked by BFSU and reported to the exit-entry administration authorities:

(1) Having completed their studies, dropping out, taking a gap, or withdrawing;

(2) Violating Chinese laws and regulations or university management rules;

(3) Having misconducts that violate moral or social norms, and cause adverse impact;

(4) Alteration of residence status, expiration, cancellation or declaration of invalidity of their valid residence permits;

(5) Providing false personal and work-study information;

(6) Other circumstances when BFSU deems it inappropriate for the students to continue work-study activities due to its negative impact on the students’ academic performance, etc.

Article 25 If an international student exceeds the scope or time limit of his/her work-study permit, the exit-entry administration authorities shall investigate and handle such circumstances according to the law. BFSU shall then impose disciplinary penalties based on the handling results in accordance with relevant rules.

Article 26 Handling of accidents and disputesrelated towork-studyactivities for international students:

(1) In the event of work-related injuries or other accidents duringwork-study activities, international students shallpromptly report to theOverseas Students Affairs Office.

(2) In case of accidents or labor disputes, all parties shallseek solutions throughnegotiationsaccording to the Agreement. If no agreement can be reached,theyshall be handled in accordance with the relevant laws and regulations of China.

VII. Supplementary Provisions

Article 27 The foreign language version of theseMeasures is for reference only. The Chineseversionshall prevailforthe final interpretation and implementation of the Measures.

Article 28 Matters not covered herein shall behandledaccording to relevant national and university policies. In the event of changesinChina’slaws and regulations or regulations from higher authorities, the revised provisions shall prevail.

Article 29 These Measures shall come into effect from the date of publication, and theOverseas Students Affairs Officeshall be responsible for interpretation.
